Terms and conditions
1. Use of the Site
The Site is intended to provide general information about our practice, services, providers, and to support administrative functions such as appointment requests, patient portal access, and bill payment. You agree to use the Site only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the Site in any way that could damage, disable, or impair it, or interfere with any other party’s use of the Site
- Attempt to gain unauthorized access to any account, system, or network connected to the Site
- Use any automated system (bots, scrapers, etc.) to access the Site without our prior written consent
- Upload or transmit viruses, malware, or other harmful code
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
2. No doctor-patient relationship
Use of this Site, including submitting a contact form, requesting an appointment, or exchanging messages through the patient portal, does not by itself create a doctor-patient relationship. A doctor-patient relationship is established only after you have been formally accepted as a patient and have had an in-person or telehealth encounter with one of our providers, consistent with our internal registration and intake procedures.
3. Medical disclaimer
The content on this Site — including text, graphics, images, and other material — is for general informational purposes only and is not intended as, and should not be relied upon as, medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician or other healthcare provider with any questions you have regarding a medical condition.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Site, our contact forms, the patient portal, or email to communicate urgent or emergency medical concerns, as these channels are not monitored continuously.
4. Appointments and cancellations
Requesting an appointment through the Site does not guarantee a confirmed appointment time; all requests are subject to confirmation by our staff. Please refer to the cancellation policy provided at the time of scheduling, or contact our office directly at [phone number] for our current cancellation and no-show policy.
5. Patient portal
If you are issued credentials to access our patient portal, you are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account. Notify us immediately at [contact email/phone] if you suspect unauthorized access to your account. Use of the patient portal is also governed by any separate portal terms of use presented to you at enrollment.
6. Online bill payment
Online payments made through the Site are processed through a third-party payment processor. We do not store your full payment card information on our systems. By submitting a payment, you represent that you are authorized to use the payment method provided. All sales are subject to our billing office’s standard refund and correction procedures — contact our billing department at [billing phone/email] with any payment disputes.
7. Intellectual property
All content on the Site — including the Gilbert Center name, logo, text, graphics, and design — is owned by or licensed to Gilbert Center for Family Medicine and is protected by applicable intellectual property laws. You may view and print pages from the Site for your own personal, non-commercial use, but may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.
8. Third-party links
The Site may contain links to third-party websites (for example, our patient portal provider, payment processor, or health resource partners). These links are provided for your convenience only. We do not control and are not responsible for the content, privacy practices, or availability of any third-party site.
9. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is accurate, complete, or current.
10. Limitation of liability
To the fullest extent permitted by law, Gilbert Center for Family Medicine shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless Gilbert Center for Family Medicine, its providers, staff, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Site.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
